Conservation Commission
Meeting
March 4, 2004

Peg Arguimbau Chairman, Katherine Roth, Janet Dunlap, and Stephan Glicken were the members present. Hank Langstroth arrived at 7:40 p.m., Peter Holden at 8:00 p.m., and Stephen Cremer at 8:05 p.m.

7:30 p.m., Public Hearing, Abbreviated Notice of Resource Area Delineation, Mirrione Realty Trust.The proposed review of the submitted wetland resource boundary in the vicinity of land at 157 North Main Street:

Peg opened the Hearing without a quorum.
Abutters were present in the audience. (See list attached)
Katherine Roth recused herself from the Hearing, as she is an abutter to the property.
Mark Manganello, Assistant Director of Ecological Services at LEC Environmental Consultants represented the Applicant and submitted green abutter cards to the Commission. Mark submitted "Plan to accompany ANRAD, Plot 67, 57 North Main Street, dated 2/13/04," to the Commission. The 20.76-acre parcel is located east of N. Main Street. A large BVW system associated with Trowell Shop Pond and Massapoag Brook is located to the east, encroaching onto the eastern portion of the property. The topography in the west and central portions of the proposed site slopes downward to the North toward Lantern Lane.
Mark Manganello visited the proposed site on January 26 & 27, 2004 to identify protected wetland resources under the Town of Sharon's By-law and under the Massachusetts Wetlands Protection Act. Mark explained that due to frost conditions, comprehensive soil testing on the proposed site was not possible.
Mark seeks to confirm with the Commission the limits of the resource areas and the 100-year floodplain delineation, as submitted on the proposed plan.  Mark stated that the overlay of the proposed delineated wetland line is generally the same as the wetland line presented from a previous filing.
Hank Langstroth arrived at this point - quorum
Greg stated that an analysis report completed by ENSR, Inc. indicates the possibility of a vernal pool inside the wetland line on the lower area of the proposed site.
Mark will perform auger tests and arrange a site visit with Greg to review soils along the wetland line on the lower portion of the property.
Abutter, Gerald Wine, 33 Lantern Lane. - inquired if the Commission had more information available pertaining to the future plans of the proposed project.
Peg stated that the Applicant recently met with the Planning Board to review a preliminary proposal of the project. She explained that abutters would be notified when the Planning Board holds an official hearing with the Applicant.
Mr. Wine asked the Commission how the abutters could obtain an opportunity to present, from their point of view, that the wetland lines from a previous filing were too small.
Peg encouraged abutters to submit any information to the Commission in terms of photographs or written comments regarding conditions that they have noted pertaining to the wetlands on the property.  
Abutter, Katherine Roth, 54 Huntington Ave.- noted that a water well present on the site has not been recorded on the proposed plan. Kathy recalled that there was never an actual wetland line approved in the previous filing. Mark stated that there was a letter submitted by ENSR, the consultant company hired by the Commission, stating that the wetlands were delineated accurately. Kathy observed an error on the filing application that states that Horsely and Witten had agreed with ENSR, regarding the wetland line; however, Horsely and Witten were never permitted on the property to fully evaluate the wetlands.
Abutter, Pat Abber, 60 Cheryl Drive. - Peg answered questions relating to the BVW Line abutting her property.
The Commission established to visit the site to inspect the lower edge of proposed site.
Peg called for a motion to continue the hearing until March 18th at 7:45 p.m.
Stephan Glicken moved. Janet Dunlap seconded. Voted. Unanimous.

8:00 p.m. Commission's Report of the wetland boundaries at 18 Franklin Road, Sheila Advani:  

Peg explained to Sheila Advani that the wetland issues on the property restrict construction opportunities. She said that the Commission would be willing to consider an expansion that won
Sheila Advani said that she was thinking of adding a small kitchen and dining area off of the existing
1st level of the house.
Greg stated that a formal in-law apartment is a zoning issue and requires a special permit.
The Commission recommended that Sheila Advani contact the Building Inspector, Joe Kent, to schedule a meeting to discuss the building plans.
Greg would arrange a site visit with Joe Kent and then contact Sheila Advani to review the Building Inspector's recommendations.
This Commission discussed with Sheila Advani the process for applying for a real estate tax abatement on her property. The Commission agreed to prepare a letter for Sheila Advani confirming the presence of wetlands on her property.   

8:20 p.m., Signatures:

The Commission signed bills. Extension Permit for herbicide treatment to Briggs Pond.
DEP # SE-280-249. Extension Permit for herbicide treatment to Essex Pond. DEP # SE-280-252.

8:25 p.m., The Commission to review letters written by the MassLand digest informing taxpayers of the opportunity to support the Endangered Species Program by submitting a voluntary donation  when filing a State income tax return.
The Commission to discuss submitting a similar letter to the Sharon Advocate.  
                
The Commission reviewed the subject and agreed to refer the information to the Friends of Conservation.

8:30 p.m. General Business:

                 The Commission discussed a list of possible Conservation parcels to submit to the
                  Planning Board to swap for the development of affordable Housing.

8:45 p.m. Approve Past Meeting Minutes:

Peg called for a motion to approve the February 12, 2004 Meeting Minutes.
Peter Holden moved. Katherine Roth seconded. Voted. 3-0-3.

8:50 p.m. The Commission Discussed 157 North Main Street Preliminary Proposal:
                
The Commission established to hire wetland consultants to review the soils on the lower portion
of the property.
